Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and HKitty Enterprises ("Two Makes One", "we", "us", or "our") and govern your access to and use of the Two Makes One application, websites, and related services (together, the "Service"). By creating an account, tapping to accept, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent and warrant that you are 18 or older, that you have the legal capacity to enter into these Terms, that you are not barred from using the Service under the laws of your jurisdiction, and that you are not a registered or convicted sex offender. You may hold only one account, and you agree that the information you provide is accurate and kept current.

2. What the Service is

Two Makes One is an anonymous, personality-first dating product. You take a personality test, you are introduced to one person a night, and photos stay hidden until both people agree to reveal. The Service is currently offered as a preview. It may change, be interrupted, or be discontinued at any time, and introductions, matches, and outcomes are not guaranteed.

3. Your account

You are responsible for activity that occurs under your account and for keeping your sign-in credentials secure. Notify us promptly of any unauthorized use. We may refuse, suspend, or reclaim any account or username at our discretion.

4. Your content

You write your own card, bio, and notes, and you provide your own photos ("Your Content"). You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate and provide the Service, including showing it to the people you are introduced to. You represent that you own or have the rights to Your Content and that it does not violate these Terms or the rights of others. We may remove any content at our discretion.

5. Photos and reveal

Faces stay hidden until both people agree to reveal them. By using the Service you consent to this reveal mechanic. A decision to reveal cannot be reliably undone once another person has seen a photo. Do not share images you are not comfortable another member seeing.

6. Community rules and zero tolerance

There is zero tolerance for objectionable content and abusive behavior. You agree not to, and not to help anyone else:

(a) post or send hate speech, slurs, or harassing, threatening, or demeaning content; (b) post or send sexual or explicit content in notes, bios, or any public area; (c) contact, pursue, or attempt to reach a person who has declined or ended contact ("a no is the end of it"); (d) send spam, solicitations, or advertising; (e) impersonate anyone, create a fake or misleading profile, or misrepresent your identity or age; (f) involve or depict minors in any way; (g) engage in illegal activity, fraud, or the sale of goods or services; (h) collect other members' information, or use bots, scrapers, or automation; or (i) attempt to interfere with, disrupt, or reverse engineer the Service.

7. Reporting and enforcement

You can report or block another member from within the Service. Reporting a person blocks them from you and files a report to a human review queue. We review reports and may remove content, issue warnings, and suspend or terminate accounts that violate these Terms, with or without notice. We aim to act on reports of egregious content promptly, typically within 24 hours. We may also remove content or accounts to comply with law or protect members.

8. Safety and assumption of risk

We do not conduct criminal background checks or verify the identity of members beyond the in-app phone and photo checks, and those checks are not a guarantee. We are not responsible for the conduct of any member, online or offline. You are solely responsible for your interactions with other people and you use the Service and meet other members at your own risk. Use good judgment, meet in public, and tell someone you trust. To the fullest extent permitted by law, you release us from claims arising out of your interactions with other members.

9. Plus, subscriptions, and payments

Matching is always free and is never for sale. Plus is an optional extra that adds rewind, skipping the reveal wait together, and cosmetic colors and frames. Plus never buys extra people, extra introductions, or likes. Plus is $9 a month or $72 a year.

During the preview the Service does not charge you and any Plus features shown are labeled "Preview. Not billed." When the iOS app ships, Plus is sold as an auto-renewing subscription billed by Apple through your Apple ID and is subject to Apple's terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Manage or cancel in your Apple ID subscription settings. Payments are non-refundable except where required by law or by Apple's policies. The first reveal-wait skip is available 12 hours in unless you already have Plus.

10. Intellectual property

The Service, including its software, design, and brand, is owned by us and protected by law. We grant you a limited, personal, revocable, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as allowed by these Terms.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what we collect and how we handle it. Please review it.

12. Termination

You may stop using the Service and delete your account at any time in Settings. We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or to protect the Service or its members. Sections that by their nature should survive termination will survive.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error free, that any introduction will lead to a match, or that a match will lead to any outcome. This is a preview and it can go down.

14. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or 100 dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, and expenses, including reasonable legal fees, arising out of your content, your use of the Service, or your violation of these Terms or the rights of another.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States without regard to its conflict-of-laws rules. Before filing any claim, you agree to first try to resolve it informally by contacting us. Any dispute that is not resolved informally will be settled by binding arbitration on an individual basis, and you and we waive the right to a jury trial and to participate in a class action, except where such a waiver is not permitted by law. Nothing here prevents either party from seeking relief in small claims court.

17. Apple

These Terms are between you and us, not with Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the app. To the extent permitted by law, Apple has no warranty obligation, and any claims, losses, liabilities, or costs attributable to a failure to conform to a warranty are our responsibility. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to let you know. Your continued use of the Service after changes take effect means you accept the updated Terms.
